FAQs
What is an amicable divorce?
An amicable divorce is where both parties agree to end the marriage without blame, conflict, or court battles. It typically involves mutual agreement on issues like finances and child arrangements.
Do we still need a solicitor if we agree on everything?
Yes. Even in amicable cases, legal advice is important to ensure the agreement is fair, properly documented, and legally binding—especially for financial settlements and child arrangements.
Can we use the same solicitor for an amicable divorce?
No. A solicitor can only act in the best interests of one party. However, one of you can instruct a solicitor while the other seeks independent legal advice, or you may both use a mediator alongside separate legal support.
What are the benefits of an amicable divorce?
It’s usually quicker, more cost-effective, and less stressful. It also supports better long-term communication, especially where children are involved.
Do we have to go to court?
Not usually. Most amicable divorces are handled entirely through written agreements and applications. Court appearances are only needed if there’s a dispute or the court needs to approve a financial order.
What if we start amicably but then disagree?
That’s not uncommon. If new issues arise, we can still continue to guide you through the process, advising of changes in circumstance including time frames and costs.
Is an amicable divorce suitable if we have children?
Yes. In fact, it's often the best option. We can help you create parenting agreements that reflect your children's best interests and minimise disruption.
What are the time-frames and costs for an amicable divorce?
An Amicable Divorce is usually a lot quicker than a divorce, as both parties are (in most) agreed on most elements of the divorce. This allows for costings to also be lower, however we only advise on this on a case to case basis.
